Welcome to Mistee!

Important: These Terms of Service ("Terms") apply to the Mistee mobile application ("Mistee", "Mistee App", "we", "us", "our") developed and operated by Mistee Inc.

These Terms of Service ("Terms") govern your use of Mistee, our website, mobile applications, and services (collectively, the "Service"). By using Mistee, you agree to be bound by these Terms. If you don't agree to these Terms, please don't use our Service.

Please read these Terms carefully. They contain important information about your rights and obligations.

Account Terms

Creating an Account

  • You must be at least 13 years old to use Mistee
  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • One person or legal entity may maintain only one account
  • You may not use another person's account without permission

Account Responsibilities

  • You are responsible for all activity under your account
  • You must notify us immediately of any unauthorized use
  • You may not use your account for illegal purposes
  • We may suspend or terminate accounts that violate these terms

Content Guidelines

Your Content

  • You retain ownership of content you post on Mistee
  • You grant us a license to use, display, and distribute your content
  • You are responsible for the content you post
  • Content must not violate laws or third-party rights
  • We may remove content that violates our guidelines

Prohibited Content

  • Illegal content or content promoting illegal activities
  • Harassment, bullying, or threats
  • Hate speech or discrimination
  • Sexually explicit content involving minors
  • Spam or misleading content
  • Content that violates others' privacy

Subscriptions and Auto-Renewable Subscriptions

Available Subscription Plans

Mistee offers the following subscription plans:

  • Basic Plan: €2.99/month - Unlock up to 10 secrets per day
  • Premium Plan: €5.99/month - Unlock up to 25 secrets per day
  • Unlimited Plan: €9.99/month - Unlimited secret unlocking

Subscription Terms

  • Payment: Payment will be charged to your Apple ID account at confirmation of purchase
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period
  • Subscription Management: You can manage your subscription and turn off auto-renewal in your Account Settings after purchase
  • Cancellation: Current active subscription period cannot be cancelled. You can cancel renewal for the next billing cycle at any time
  • Free Trial: If we offer a free trial, any unused portion of the trial period will be forfeited when you purchase a subscription

Subscription Cancellation

To cancel your subscription:

  • Open the Settings app on your iOS device
  • Tap your name at the top
  • Tap "Subscriptions"
  • Select Mistee
  • Tap "Cancel Subscription"

Alternatively, you can manage subscriptions through:

  • App Store app → Your Profile → Subscriptions
  • App Store Connect (for developers)

Refund Policy

All subscription purchases are handled by Apple. Refund requests must be submitted to Apple directly:

We do not have access to process refunds for App Store purchases. Apple's refund policies apply.

Changes to Subscription Pricing

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. We will notify you in advance of any price changes.

If you do not wish to continue at the new price, you may cancel your subscription before the price change takes effect.

Safety and Security

Community Safety

  • Report inappropriate content or behavior immediately
  • Do not share personal contact information publicly
  • Be cautious when meeting people from the app
  • We are not responsible for user interactions
  • We may share information with law enforcement when required

Account Security

  • Use a strong, unique password
  • Enable two-factor authentication when available
  • Do not share your login credentials
  • Log out of shared devices
  • Keep your app updated to the latest version

Prohibited Activities

You may not:

Limitation of Liability

  • Mistee is provided 'as is' without warranties
  • We are not liable for user-generated content
  • We are not responsible for lost profits or data
  • Our liability is limited to the amount you paid us
  • Some jurisdictions don't allow these limitations

Indemnification

  • You agree to defend and hold us harmless
  • This includes claims arising from your use of Mistee
  • This includes your violation of these terms
  • We may assume defense at our own expense

Dispute Resolution

We prefer to resolve disputes amicably. If you have a concern, please contact us first at support@mistee.app. Most issues can be resolved quickly and to everyone's satisfaction.

If we can't resolve the dispute informally, you agree to binding arbitration under the rules of the American Arbitration Association. The arbitration will be conducted in English and the decision will be final.

You agree to resolve disputes with us individually, not as part of a class action. This means you cannot bring a class action lawsuit against us or participate in one.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in Delaware.

Changes to Terms

We may modify these Terms at any time. If we make significant changes, we'll notify you through the app or by email. Your continued use of Mistee after changes take effect means you accept the new Terms.

If you don't agree to the new Terms, you must stop using Mistee. We'll always post the most current version of our Terms on this page with the effective date.

Termination

You can terminate your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion.

Upon termination, your right to use Mistee will cease immediately. Provisions that should survive termination will remain in effect.
